Supreme Court judge orders reopening of Guterres case
'Tempo', Jakarta, in Indonesian 12 Oct 00
Text of report by Indonesian newspaper 'Tempo' on 12th October
Tempo Interaktif, Kupang: The Supreme Court Justice ordered the East
Nusa Tenggara High Court to reopen the illegal gun possession case against
Eurico Guterres. During a previous trial, the Kupang District Court
dismissed the Guterres case. The former Chief Justice of the East Nusa
Tenggara High Court, Said A. Harahap, announced the order to reopen the
case following the inauguration of his successor, FX Samijo SH, at the
office of the East Nusa Tenggara Governor in Kupang today.
The order to resubmit charges against Guterres comes after allegations
of improper and unreasonable conduct by Guterres' defence lawyer. One
allegation concerns the employment status of Eurico. At several trial
hearings, Eurico wore army-style camouflage. At other times, he wore
casual civilian clothing.
"The District Court's reason for dismissing Eurico's case is
improper and must be rejected. Therefore, the case will be reopened,"
said Harahap, who will take his new job as Supreme Court Justice.
According to Harahap, the justices have not yet chosen a trial location.
