Unofficial Translation - Original Portuguese below [thanks to the translator] Terms of Reference * The enhancement of democratic dialogue with all social sectors and a permanent protection of national unity are the directing principles in every government actions. In this light, the government feels a duty to offer the following response to the documents which was delivered to it last Monday by two representatives of the 591 petitioners: * Of the ten points demanded in that document, only point number 7 was directed to the RDTL Government. The other 9 points, in fact, were demands directed at other Sovereign Bodies or particular references to individuals, fracts or institutions. * In demonstrating that repudiation of any form of discrimination and division constitutes the fundamental pillars of this Government, the Prime Minister, in consonance with the President of the Republic and the President of the National Parliament, have decided to set up an effective and consensually accepted mechanism, with the objective of analysing the petitionists' grievances related to the incidents of discriminations and mistreatments within F-FDTL, and to hear the respective Leaders to obtain their opinions. * Therefore, it is decided that the Committee of Notables to be composed of 8 currently serving members, 2 to be appointed by the Government, 2 to be appointed by the President of the Republic, 2 to be appointed by the National Parliament, and one to be appointed by the Superior Council of the Judicial Magistrature, and another one to be appointed by the Catholic Church. Other than these individuals, two representatives from the civil society will also take part as consultative members. The government has appealed to the President of the Republic, the President of the National Parliament, to the President of the Superior Council of the Magistrature and to the Church hierarchy to appoint their representatives to this Committee. * The Committee has a maximum functioning term of 90 days beginning from the day of its investiture, to elaborate a report surrounding the incidents of discriminations and mistreatments within the F-FDTL. * The Committee can also comment on the Act regarding the Regime of Military Promotions, which the Government has elaborated. * Other than the constitution of this Committee of Notables, the Government also commits itself to offering the 591 peticioners the conditions for effective social reintegration in order for them to guarantee an honourable maintenance of their respective families and their dignified reintegration within the civil life. * The Committee will submit their conclusions and recommendations to H.E. The Prime Minister whom, in coordination with other Sovereign Bodies, will make a decision with respect to the matters. REPÚBLICA DEMOCRÁTICA DE TIMOR-LESTE Gabinete do Primeiro Ministro TERMOS DE REFERÊNCIA 1. A valorização do diálogo democrático com todos os sectores sociais e a permanente guarda da unidade nacional são princípios directores em todas as acções do Governo. Nesse quadro, o Governo sente-se no dever de oferecer a seguinte resposta ao documento que lhe foi entregue, na última segunda-feira, por dois representantes dos 591 peticionários: 2. Dos dez pontos constantes daquele documento, apenas o do numero 7 é dirigido directamente ao Governo da RDTL. Os demais nove pontos são, na verdade, pedidos a outros Órgaos de Soberania ou apreciações particulares a respeito de pessoas, factos ou instituições. 3. Tendo em vista demonstrar que o repúdio a qualquer forma de discriminação e divisionismo constitui um pilar fundamental deste Governo, o Primeiro Ministro, em consonância com os Senhores Presidente da República e Presidente do Parlamento Nacional, já havia decidido constituir um mecanismo eficaz e aceitável consensualmente, com o objectivo de analisar as queixas dos peticionários relativamente a eventuais discriminação e maus-tratos dentro das F-FDTL, e ouvir o respectivo Comando para receber as suas opiniões. 4. Assim, decidiu-se constituir uma Comissão de Notáveis a ser formada por oito membros efectivos, dois indicados pelo Governo, dois indicados pelo Presidente da República, dois indicados pelo Parlamento Nacional, um indicado pelo Conselho Superior da Magistratura Judicial e mais um indicado pela Igreja Católica. Além destes também farão parte, como membros consultivos, dois representantes da sociedade civil. Desde já o Governo apela ao Presidente da República, ao Presidente do Parlamento Nacional, ao Juiz Presidente do Conselho Superior da Magistratura e à hierarquia da Igreja para que indiquem com celeridade os seus representantes nesta Comissão. 5. A Comissão tem um prazo máximo de funcionamento de 90 dias, a partir da sua instalação, para elaborar um relatório circunstanciado sobre eventuais discriminação e maus-tratos no âmbito das F-FDTL. 6. A Comissão pode também pronunciar-se sobre a proposta de Decreto-Lei relativa ao Regime de Promoções Militares que o Governo elaborou. 7. Para além da constituição dessa Comissão de Notáveis, o Governo compromete-se a oferecer aos 591 peticionários condições de reinserção social eficazes para que possam garantir a manutenção honrada dos respectivos agregados familiares e a sua reintegração condigna na vida civil. 8. A Comissão submeterá as suas conclusões e recomendações a S.E. o Primeiro Ministro que, em coordenação com os demais Órgãos de Soberania, encontrará uma decisão sobre a matéria.
