[English scanned from fax; original Portuguese follows.] THE PRESIDENT OF THE REPUBLIC PRESIDENTIAL STATEMENT 1 EMERGENCY MEASURES TO OVERCOME THE CRISIS Having heard the Council of the State, in. its capacity as a consultative body. which met in the Palace of' the Ashes on the 29th and 30th days the month of May of the year 2006, as provided for in Sections 90 and 91 of he Constitution of the Republic, and in accordance with the provisions of Law No. 2 of 2005, and consk1ering: * The loss of lives, the generalised disturbance of the public order that is adversely affecting the safety, property and peace of the citizens, it is thus a matter of urgency to take adequate measures to re-establish the public authority throughout the territory; * The need to create conditions for the rapid re-establishment or he law and order so as to safeguard the democratic constitutional order; * The need to provide urgent humanitarian assistance to the population in need; * The serious ongoing deterioration of the functioning of the national armed and police forces; * The need to ensure that the actions, in the national territory, of the international defence and security forces, as requested to the Friendly Countries by the Organs of Sovereignty, shall fulfill the objectives of the mission as requested by the Organs of Sovereignty, without prejudice to the respect: for the juridical order in force and to the constitutional attributions for the sovereign authorities of the Country; * The constitutional functions and competencies of the President of the Republic as the guarantor of the unity of the. Slate, or the national independence and of the regular functioning of the democratic institutions, as provided for in Section 74.1 of the Constitution of the Republic; * The urgency to ensure the effective exercise of the competencies inherent to the functions of the Commander-in-Chief of the Armed Forces of the President o:I the Republic, as provided for in Sections 74.2 and 85 (b) of the Constitution; The President of the Republic, in close collaboration and permanent interaction with the Prime Minister and The President of the National Parliament, announces that he in implementing the necessary measures to prevent the violence and avoid further fatalities, for the rapid re-establishment of the public order and the normal, functioning of the democratic. institutions assuming sole [should be 'main'] responsibility in the areas of defence and national security, in his capacity as the Commander-in-Chief of the Armed Forces. This framework of collaboration and reinforced interaction shall involve the following entities: * The Ministries of Defence and interim, with the entities and services falling under their tutelage; * The High Command of Falintil-FDTL and PNTL in accordance with the provisions set out in Decree-Laws No. 7 and No. 8 of 2004; * The information and security services of the State and the Crisis Cabinet, under the tutelage of the Prime Minister in accordance with the provisions of Law No. S of 2003 and of Decree-No. 7 of 2004; * The International Armed Forces present in the National Territory, at the request of the Organs of Sovereignty; Additionally. it is expected. that the National Parliament shall meet, as soon as possible, to discuss and follow-up on the ongoing crisis. In this regard, the President of the Republic appeals for the persons who illegally possess weapons, ammunitions, explosives, home-made. weapons or any military equipment to voluntarily and promptly hand their over to the authorities, notably, to the international forces. All must promptly collaborate it the implementation of the current security measures, notably: a) With the group of persons who, by their number and nature, represent a threat to the public order; b) With the request to identify any person that is fund or circulating in public places or subject to police surveillance; c) With the surveillance of persons, buildings and establishments: or a determined period of time; and d) With the seizure of weapons, ammunitions and explosives The emergency measures announced shall not prejudice the President of the Republic from declaring a State of Siege, in accordance with the due constitutional norms, notably, with the necessary previous authorisation from the National Parliament. The measures announced herein shall enter into force immediately and shall be valid for a period of 30 days, which shall be subject to extension, should it be necessary. DECLARAÇÃO PRESIDENCIAL PRESIDÊNCIA DA REPÚBLICA DECLARAÇÃO PRESIDENCIAL MEDIDAS DE EMERGÊNCIA PARA ULTRAPASSAR A CRISE Ouvido o Conselho de Estado, como órgão consultivo, reunido nos dias 29 e 30 de Maio de 2006, no Palácio Presidencial, nos termos dos artigos 90 e 91 da Constituição da República em conformidade com o disposto na Lei n.º 2 de 2005, e considerando: . A perda de vidas, a perturbação generalizada da ordem pública que perversamente está a afectar a segurança, os bens e a tranquilidade dos cidadãos, torna urgente promover medidas adequadas à reposição da autoridade pública em todo o território; . A necessidade de criar condições para o rápido regresso à normalidade a fim de salvaguardar a ordem constitucional democrática; . A necessidade de providenciar urgente apoio humanitário às populações carenciadas; . A grave deterioração da operacionalidade das forças armadas e das forças de segurança nacionais; . A necessidade de assegurar que a actuação, no território nacional, das forças internacionais de defesa e segurança, solicitada pelos Órgãos de Soberania aos Países amigos, cumpra os seus objectivos sem prejuízo do respeito pela ordem jurídica vigente e das atribuições constitucionais das autoridades soberanas do País; . As funções e competências Constitucionais do Presidente da República como garante da unidade do Estado, da independência nacional e do regular funcionamento das instituições democráticas, nos termos do número 1 do artigo 74º da Constituição da República; . A urgência de garantir o exercício efectivo das competências inerentes às funções de Comandante Supremo das Forças Armadas do Presidente da República, nos termos do número 2 do artigo 74º e da alínea b) do artigo 85º da Constituição: O Presidente da República, em colaboração estreita e articulação permanente com o Primeiro-Ministro e o Presidente do Parlamento Nacional, anuncia que está a providenciar as medidas necessárias para prevenir a violência e evitar mais mortos, para o rápido restabelecimento da ordem pública e do normal funcionamento das instituições democráticas, assumindo a responsabilidade principal nas áreas da defesa e segurança nacionais, na qualidade de Comandante Supremo das Forças Armadas. Este quadro de colaboração e articulação reforçada envolve as seguintes entidades: . Os Ministérios da Defesa e do Interior com as entidades e serviços deles pendentes: . Os Comandos das Falintil-FDTL e da PNTL, nos termos dos Decretos-Lei n.º 7 e n.º 8 de 2004; . Os serviços de informação e segurança do Estado e o Gabinete de Crise, na dependência do Primeiro-Ministro, nos termos da Lei n.º 8 de 2003 e do Decreto Lei n.º 7 de 2004. . As Forças Internacionais de Defesa e Segurança presentes no Território Nacional por solicitação dos Órgãos de Soberania; Além disso, aguarda-se que o Parlamento Nacional, no mais curto prazo possível, reuna para se debruçar e acompanhar a situação de crise actual. Neste sentido, apela para que as pessoas que detenham ilegalmente, armas de fogo, munições, explosivos, armas brancas ou qualquer equipamento militar as entreguem, voluntária e prontamente, às autoridades, designadamente às forças internacionais. Todos devem colaborar prontamente com a aplicação das medidas de segurança em curso, designadamente : a) Agrupamentos de pessoas que por seu número e natureza possam representar ameaça à ordem pública; b) Exigência da identificação de qualquer pessoa que se encontre ou circule em lugar público ou sujeito à vigilância policial; c) Vigilância de pessoas, edifícios e estabelecimentos por período de tempo determinado; e d) Apreensão de armas, munições e explosivos. As medidas de emergência anunciadas não prejudicam que o Presidente da República venha a declarar o Estado de Sítio em conformidade com os preceitos constitucionais devidos, designadamente, a necessária autorização prévia do Parlamento Nacional.
