The East Timor Human Rights Centre (ETHRC) has received further information in relation to a shooting attack on August 11 1999 in the town of Viqueque, East Timor, where two students, Carlos Sarmento and Mario Gusmao (Soares) were killed by pro-Indonesian Senior 59/75 Junior Militia members who attacked a student poll information centre. The ETHRC had reported that Ferlino da Costa and Duarte Fatima (previously reported as Duarte (no surname)) sustained serious injuries to his arm during the attack and four other students were arrested, detained, beaten and since released. Marcelino Soares, previously unreported, was also shot in the attack and sustained injuries to his shoulder. Another student, Paulo da Silva was arrested by members of the militia and KODIM (District Military Command) and detained at POLRES (Police Resort Centre) in Viqueque. The ETHRC is trying to confirm whether he is still in detention.

ETHRC sources have confirmed that Duarte Fatima is still in detention at POLRES Viqueque. It is not known if any charges have been brought against him and the ETHRC believes he may have been detained solely for political reasons. The ETHRC is concerned for his safety as he may be at risk of torture and ill-treatment, a common occurrence for East Timorese detainees in police or military custody.

RECOMMENDED ACTION: Please send faxes/telegrams/express/airmail letters in English, Bahasa Indonesia or your own language: *seeking clarification of the whereabouts of Paulo da Silva; *seeking details of the charges (if any) against Duarte Fatima and Paulo da Silva (if still detained) and calling for their immediate and unconditional release if they have not been charged with a recognisable offence under existing laws; *seeking assurances that they will not face torture and ill-treatment in detention and that they are treated humanely in accordance with international standards; *seeking assurances that they will have immediate and on-going access to members of their families, humanitarian and medical assistance and legal representation; *calling on the government of Indonesia to take steps to immediately disarm all civilian militia groups in East Timor and to prosecute all those others responsible for human rights violations, including those members of the pro-Indonesian Senior 59/75 Junior Militia and KODIM Viqueque responsible for the shooting attack in Viqueque to the fullest extent of the law; and *calling for immediate and unrestricted access to be allowed to all areas of East Timor for UN human rights monitors, international and local human rights organisations, in order to provide ongoing human rights monitoring, and in particularly to conduct a full and impartial investigation of the recent violations committed by the military and militias.
