Statement by ANTI (Timor-Leste National Alliance for an International Tribunal)
on the Day of the Popular Consultation, 30 of August 1999 – 2011
and also the International Day of the Disappeared

Resolving Past Crimes Against Humanity is Key to Opening the Door to Truth and Justice now and in the future…
 
Today… we bow before all victims of serious crimes and crimes against humanity. The brutality of the Indonesian military took away thousands of human lives. In that time, assassinations by the Indonesian Military and pro-Indonesian militia made Timorese human lives worthless. Immoral actions eliminated the dignity of our mothers and sisters.
  Today we only give importance to friendship, not to truth. How can we move forward if we are not willing to fill the holes of the past? How can we progress together with new hope if we ignore the heavy burden on our shoulders?

Until today, these scars have not healed because we live in an climate of hypocrisy. We are hypocrites because we don't want to feel what the victims feel today. We are hypocrites because we forget our innocent people who lost their lives. We are hypocrites because we are not willing to look for those who were forcibly disappeared. We are hypocrites because we give priority to reconciliation, not to justice.

The 30th of August marks Popular Consultation Day for the Timorese People. For the international community, 30 August is also ‘International Day of the Disappeared’. The CAVR report estimates that 186,000 people were killed and forcibly disappeared in the years before the 1999 referendum. Four thousand children taken by the TNI (Indonesian Military) have not yet returned. Until today, we cannot follow their trails. We do not yet know these families' shadows ... we continue to hope that those who the Military and Militias took will return to each of their families.

Today we only give importance to friendship, not to truth. How can we move forward if we are not willing to fill the holes of the past? How can we progress together with new hope if we ignore the heavy burden on our shoulders? Because of these realities ANTI:

  • Demands that the United Nations Security Council pass a resolution to establish a credible International Tribunal in order to judge the principal perpetrators of serious crimes and crimes against humanity in Timor-Leste during the Indonesian occupation so that we can cut the chain of impunity in Timor-Leste and other countries.
  • Demands that the Prosecutor prosecutes the serious crimes cases that were investigated by the Serious Crimes Investigation Team (SCIT) and submits these cases to Court.
  • Asks the Judges and the Prosecutor General to imprison the criminal Valentim Lavio (ex-Militia BMP) who has already been sentenced to 9 years imprisonment but walks free today.
  • Asks the President of the Republic and the State of Timor-Leste to ratify the International Convention for the Protection of All Persons from Enforced Disappearance in order to guarantee that there will be no more disappeared persons in the future.
  • Asks the State of Timor-Leste to demand that the State of Indonesia give back those that the TNI forcibly took to Indonesia.
  • Demands that all State Institutions valorise the day of Popular Consultation, 30 August, as an important National day of commemoration at the National and District levels, rather than as a National holiday.
  • Demands that the National Parliament decide quickly on the Memory Institute Law and the Reparations Law.
  • Demands that the State Institutions of Timor-Leste respect the principle of separation of powers and respect the competence of the Judiciary to process serious crimes and crimes against humanity, in accordance with Article 160 of the Timor-Leste Constitution.
Forgetting the Crimes of the Past … is the start of killing Justice today and tomorrow.
